Proposal to update Roll Over Protection System safety standards in Ontario

The Ministry of Agriculture, Food and Rural Affairs is seeking comments on its proposal to amend Regulation 369, under the Farm Implements Act to reflect the harmonization of the Canadian Standards Association (CSA) and International Organization for Standardization (ISO) standards for Roll Over Protection Systems (ROPS) on agricultural machinery.  You can review the proposed revisions and submit your comments on the Regulatory Registry website.  Comments can be submitted until May 23, 2017.

The proposed changes would come into force for tractors sold after July 1, 2017 and, with the exception of instructional seats, tractors manufactured prior to the July 1, 2017 would not be required to meet the above changes.

The Ministry of Agriculture, Food and Rural Affairs is seeking comments on its proposal to amend Regulation 369, under the Farm Implements Act to reflect the harmonization of the Canadian Standards Association (CSA) and International Organization for Standardization (ISO) standards for Roll Over Protection Systems (ROPS) on agricultural machinery.

The CSA recently updated a number of standards governing Roll Over Protection Systems (ROPS) for agricultural machinery. The updated CSA standards are direct adoptions of their international counterparts, which are issued by the ISO. The equivalent ISO standards are referenced in each updated CSA standard.

Section 11 under Regulation 369, outlines the responsibility of farm equipment dealers when selling tractors equipped with ROPS. The proposed changes to the regulations would see:

•The inclusion of clause 4.4.1 of CSA B352.0-16 Rollover protective structures (ROPS), falling object protective structures (FOPS), operator protective structures (OPS), and tip-over protective structures (TOPS) for mobile machinery – General Canadian Requirements. That specific section deals with seat and seatbelts requirements in newly manufactured tractors.

•The adoption of CSA B352.0-16 Roll-over protective structures (ROPS), falling object protective structures (FOPS), operator protective structures (OPS), and tip-over protective structures (TOPS) for mobile machinery – General Canadian Requirements, which harmonizes the general ROPS standards with various ISO standards.

•The adoption of CAN/CSA-M5700-09. Tractors for agriculture and forestry – Roll-over protective structures (ROPS) – Static test method and acceptance condition and CAN/CSA-M3463-09. Tractors for agriculture and forestry – Roll-over protective structures (ROPS) – Dynamic test method and acceptance conditions, which specifies the dynamic and static testing requirements for newly manufactured ROPS on tractors, respectively, and are harmonized with ISO standards.

•The inclusion of the CAN/CSA-M23205:12. Agricultural tractors – Instructional seat standard specifying instructional seat requirements for those installed in tractors.
